Yourself at the district building authority

The way without us, step by step

In Berlin the Baulastenverzeichnis is kept by the lower building authority, i.e. the Bau- und Wohnungsaufsicht of the Bezirksamt. Only the Bezirksamt where the plot lies gives information, e.g. Mitte at Müllerstraße 146, Pankow at Storkower Straße 97 or Treptow-Köpenick at Alt-Köpenick 21.

  • Informal written application by post, fax or scanned by e-mail, each with the applicant's handwritten signature.
  • State street and house number, where applicable land register sheet number, Flur and Flurstück.
  • You prove the legitimate interest sufficiently, e.g. as owner or as prospective buyer.
  • Costs compared: 17 euros per plot without Baulast, 29 euros for copies of existing Baulasten. With us 42.90 euros including the fee if there is no Baulast; if one is registered, we state the extra amount before payment. We are not an authority and do not assess any Baulast.

In Berlin an interest in buying is enough

Prospective buyers may ask

For the Baulastenverzeichnis, the State of Berlin names two examples of legitimate interest: plot owners and prospective buyers. Anyone who wants to buy a property can therefore apply for the information themselves if they prove the interest sufficiently. The land register is stricter: without ownership or power of attorney you need factual reasons; mere curiosity is not enough there.

More about Berlin (2)

The state's fee list counts per plot: the negative certificate costs 17 euros, copies of existing Baulasten 29 euros, also as a photocopy. The legal basis is § 84 paragraph 5 of the Bauordnung für Berlin.

A Baulast arises from the owner's written declaration to the building authority, e.g. when setback or parking areas are taken over or plots are merged. For the application you need Flur and Flurstück; both are on the cadastral map, which the district surveying office issues for 16 euros per sheet.

Questions about building encumbrance information in Berlin

What does building encumbrance information cost in Berlin?

Without a registered Baulast the negative certificate costs 17 euros per plot. If Baulasten exist, the copies, also as photocopies, cost 29 euros per plot. At Behördenfix you pay 42.90 euros including the fee if there is no Baulast; otherwise we state the extra amount before payment.

Where do I apply for the information in Berlin?

At the Bau- und Wohnungsaufsicht of the Bezirksamt where the plot lies; another Bezirksamt may not give the information. Examples are Friedrichshain-Kreuzberg at Yorckstraße 4-11, Lichtenberg at Alt-Friedrichsfelde 60 and Tempelhof-Schöneberg at John-F.-Kennedy-Platz 1. We find the Bezirksamt from the address.

Can I apply for the information by e-mail?

Yes, as a scanned application. The state requires an informal written application by post, fax or scanned by e-mail, each with a handwritten signature. A plain e-mail without a signed application is not enough. Add the details of the plot and proof of legitimate interest.

Who may inspect the Baulastenverzeichnis Berlin?

Anyone who shows a legitimate interest. The state names plot owners and prospective buyers as examples. You must prove the interest sufficiently, e.g. with proof of ownership or papers on the planned purchase. Without this proof the building authority gives no information. Behördenfix applies with your power of attorney and your proof.

What is a negative certificate?

The building authority's confirmation that no Baulast is registered for the plot. In Berlin it costs 17 euros per plot. If a Baulast is registered, you get copies of the existing Baulasten instead for 29 euros per plot. What the Baulast means for your project we do not check; architects or law firms do that.

Where do I find Flur and Flurstück for the application?

On the cadastral map. A non-official printout is free on the Geoportal Berlin. An official extract is issued by the surveying office of the district where the plot lies, for 16 euros per sheet, usually within two weeks. Otherwise street and house number are enough for the application.
