What is special in Dortmund

Katasteramt instead of building authority

In Dortmund, only the Katasteramt gives information from the register of building encumbrances.

More about Dortmund (4)

An encumbrance is created at the building authority, the Stadtplanungs- und Bauordnungsamt. But the declaration, site plan and Baulast sheet are archived at the Katasteramt, which keeps the register. The cadastre marks burdened and benefiting parcels with the encumbrance number.

For written information with an encumbrance, Dortmund charges up to 200 euros per plot. In Essen it is 50 euros per encumbrance, at most 200 euros; Köln charges 15 euros for information without encumbrance. The Dortmund service page names no online application.

City examples: access to the building plot runs over the neighbouring plot, or the neighbour takes over part of the distance area. An encumbrance also binds the legal successor, so it continues after a sale.

The building authority only checks the land register of the burdened plot immediately before registration. If further rights are already in the second section, such as priority notices or a usufruct, the city says to state this in the application. For the procedure, the building authority gives the numbers 0231 50-27957 and 0231 50-22638.

Questions about building encumbrance information in Dortmund

Do I need the information before buying a house?

The city of Dortmund writes that for any legal transaction with plots, especially a purchase, an overview of building encumbrances makes sense. The register extract serves this. We do not assess whether an encumbrance affects your purchase; we obtain the information.

Is a building encumbrance in the land register?

No. According to the city of Dortmund, building encumbrances are not entered in the land register; the declaration goes only to the building authority, so a land register extract does not show them. The city expressly recommends an extra easement in the land register, as the encumbrance creates no private-law relationship.

How much does building encumbrance information cost in Dortmund?

According to the Katasteramt's price list, 30 euros per plot for written confirmation that no Baulast sheet exists, and 50 to 200 euros per plot for written information from the register. With us, information without encumbrance costs 42.90 euros including the fee.

Where do I get the extract in Dortmund?

At the Vermessungs- und Katasteramt, Märkische Straße 24-26, in writing with the order form or in person Monday to Thursday from 9 to 12. The building authority at Burgwall gives no information from the register; it creates and deletes encumbrances.

How much does registering or deleting an encumbrance cost?

At the city of Dortmund's building authority, registering an encumbrance costs between 50 and 250 euros, deleting one the same. An encumbrance is deleted when there is no longer a public interest in it. Procedure questions: Burgwall 14, room 142.

Who must agree to a building encumbrance?

According to the city of Dortmund's building authority, besides all owners, holders of hereditary building rights and of priority notices for conveyance and transfer of ownership, usufructuaries and reversionary heirs must take part. Beneficiaries of easements and creditors of land charges are not involved. It takes effect on entry in the register.
